Jack & Jill Privacy Notice

At Jack & Jill, we are committed to protecting your privacy. This Privacy Notice (“Notice”) provides you with information concerning our practices and procedures as they relate specifically to the services we provide. For the purposes of the EU General Data Protection Regulation (EU Regulation 679/2016) (the “GDPR”), Jack & Jill is the data controller with regard to the personal data described in this Privacy Statement.

“Data controllers” are the people who or organisations which determine the purposes for which, and the manner in which, any personal data is processed, who/which make independent decisions in relation to the personal data and/or who/which otherwise control that personal data.

What Does This Privacy Statement Cover?

This Privacy Statement explains how Jack & Jill use your and your child’s personal data: how it is collected, how it is held, and how it is processed. It also explains your rights under the law relating to your and your child’s personal data. In summary:

  • We respect your and your child’s personal data.
  • We will store it securely.
  • We will only share your and your child’s personal data for specific reasons as outlined below.
  • We will delete it when you ask us to.
  • We may send you content we think is relevant or interesting to you but only if you have consented to this.

Collecting your Personal Data

This policy covers all Personal Data held in relation to data subjects including the Special Categories of Personal Data, otherwise described as sensitive data, as set out in Article 9 of the GDPR and Sections 2 and 69 of the Data Protection Act 2018, as enacted, by Jack and Jill and applies to personal data coming within the scope of Article 2(1) of the GDPR. All personal and special categories of personal data will be equally referred to as Personal Data in this Policy, unless specifically stated otherwise.

How do we collect your data?

Jack & Jill collects personal data in a number of different ways. This might be from a referral made by a third party, or perhaps directly from you – in person, over the telephone or in a form you have completed online or in paper format. This will be from the information you provide in the service user pack for us. This may also be from emails and telephone communication and meetings with you. There may also be times when data is collected from others such as family
members involved in the service provision.

Service User Privacy Notice

In the delivery of the services we provide, health specific data will be collected by the nurses and staff taking care of your child and will be held in the child’s record (this may be paper and/orelectronic).

What data do we collect?

The data that we collect about you and your child may include details such as:

  • Name, address, telephone, email, date of birth and next of kin;
  • Any contact we have had with you and your child through visits and appointments
  • Details and records of treatment and care, notes and reports about your child’s health
  • Other relevant information from people who care for your child and know the child well, e.g. health professionals, relatives and carers;
  • We may also collect other data about you and your child , such as whether you or your child have a disability or require any additional support with appointments (like an interpreter or advocate);
  • Marketing and Communications Data: your preferences in receiving marketing from us

How and Why we use your Personal Data

If you do provide us with personal data about yourself or your child we will only use it for the purposes described where it is collected. Specifically, we may use the personal data which you provide in the following ways:

  • To provide a safe and effective care service
  • To communicate with you and keep you updated
  • To manage risk
  • To adhere to any legal obligations
  • To manage payments related to the service provided
  • to promote our charitable aims, including fundraising events or campaigns, where you agree to receive such information;

Jack and Jill will process the personal data which you provide based on the following grounds:

  • Your consent – where processing is based on your consent, you have the right to withdraw that consent
  • Where it is necessary for compliance with a legal obligation
  • To protect your and your child’s vital interests
  • For reasons of public interest in the area of public health
  • Where we have a legitimate interest in sharing marketing and communications with you

Sharing your Data

We only disclose personal data provided by you to external third parties in connection with specific purposes and compliance, including:

  • Third parties who provide services to Jack and Jill
  • Other health care organisation that are involved in the child’s care, HSE services such as Public Health, GPs, community services;
  • Authorities and bodies where required or permitted by law

We will not sell, license, transmit or disclose your or your child’s personal data outside of Jack and Jill or its affiliates without notice to you unless (1) you expressly authorise us to do so, (2) it is necessary to allow our service providers, representatives, or agents to provide services for or to us, (3) it is necessary to provide our products or services to you, (4) it is necessary to protect and defend the rights or property of Jack and Jill, (5) it is necessary to act in urgent circumstances to protect the personal safety of Jack and Jill service users, staff or the public, or (6) otherwise as we are required or permitted by law.

We require all third parties to enter into a data processing agreement with us which complies with our obligations under the GDPR. This agreement requires third parties to have appropriate security systems in place and only to use your personal data on our instructions and in accordance with data protection law.

Security of your Personal Data

Jack and Jill is fully committed to ensuring that your and your child’s personal data is secure with us and with the third parties who act on our behalf. We have a number of security precautions in place to prevent the loss, misuse or alteration of your personal data.

We restrict access to personal data collected about you and your child to our employees, our affiliates’ employees, those who are otherwise specified in this Policy, or others who need to know that data to provide services to you and your child or in the course of conducting our business operations or activities.
We also advise all Jack and Jill employees about their responsibility to protect personal data and we provide them with appropriate guidelines for adhering to our standards and confidentiality policies. Inside Jack and Jill, data is stored in password-controlled servers with limited access. Your and your child’s data will only be stored in Ireland.

For how long do we keep your personal data?

Jack and Jill will retain your and your child’s data for as long as necessary to provide you and your child with services, and to comply with our legal and regulatory obligations.

We are committed to protecting your, and your child’s personal data to the very best of our ability and take the appropriate steps to do in collecting, storing and destroying the data.

Your, and your child’s Rights

  • The right to be informed about our collection and use of personal data – achieved through this notice
  • The right of access to the personal data we hold about you and your child , see section below
  • The right to rectification if any personal data we hold about you and your child is inaccurate or incomplete – please contact us using the contact data below
  • The right to be forgotten – i.e. the right to ask us to delete any personal data we hold about you and your child – please contact us using the contact details below
  • The right to restrict (i.e. prevent) the processing of your and your child’s personal data, please contact us using the contact data above
  • The right to data portability: this only applies in some circumstances
  • The right to object to Jack and Jill using your and your child’s personal data for particular purposes
  • Rights with respect to automated decision making and profiling: we do not use your and your child’s data in this way

Some of these rights only apply in certain circumstances; they are not guaranteed or an absolute right. Please contact us if you have any questions or concerns about your and your child’s rights. If you make a request, we have one month to respond to you.
